1.1 These Terms and Conditions govern the relationship between SMART COURIER B.V. (“Courier”) and users of its non-universal postal services, specifying the rights, obligations, and responsibilities of both parties.
1.2 Users of the Courier’s services may include all individuals, sole traders, and legal entities (“User/s”).
1.3 Parties may enter into individual contracts or supplementary agreements that complement or override these Terms and Conditions.
2.1 “Shipment” means any item or document, regardless of packaging or number of parcels, accepted by the Courier for transport from sender to recipient, accompanied by a waybill or digital tracking identifier.
2.2 “Transport” includes all operations related to pickup, handling, carriage, and delivery of the shipment.
2.3 Courier.nl is a registered trademark of SMART COURIER B.V. All rights regarding brand, visual identity, software, and platform are protected. Unauthorized reproduction or usage is prohibited without written permission.
3.1 Users are deemed informed of the Terms and Conditions once published on the Courier’s website: https://courier.nl.
3.2 Acceptance occurs through signing a contract, user registration, or handing over a shipment for delivery.
3.3 These Terms also apply to subcontractors used by the Courier for service execution.
4.1 Courier.nl offers the following key services:
– Parcel – delivery of larger shipments locally and globally.
– Tracked – affordable international service with full tracking.
– Express – express courier delivery with prioritized handling.
– Untracked – budget-friendly service without tracking.
4.2 Services may be extended with options such as insurance, cash-on-delivery, SMS/email alerts, etc.
4.3 Shipments may be accepted from the sender’s address or service points, within stated business hours.
4.4 The Courier reserves the right to choose subcontractors, transport methods, and routes.
5.1 All data in the waybill must be completed by the User. The signature confirms its accuracy.
5.2 Estimated delivery times are:
– Up to 5 business days within the Netherlands
– Up to 20 business days within the EU
– Up to 30 business days for the rest of the world
5.3 The Courier is not liable for delays caused by force majeure, customs, or local regulations.
5.4 Deliveries are made in person against a signature. Unclaimed or undeliverable shipments follow a notification and return procedure.
6.1 The Courier does not accept items considered illegal, restricted, or dangerous.
6.2 Shipments may be scanned or opened by authorities or authorized personnel in case of suspicion.
6.3 The User is fully responsible for the shipment content and declares that it does not contain prohibited items.
6.4 The User must indemnify the Courier for damages, fines, or claims arising from the shipment content.
7.1 Prices are defined in the Courier’s published Tariff or in a specific agreement.
7.2 Payment is due in advance or periodically depending on the client status.
7.3 Late payments are subject to a penalty of 0.1% per day on the owed amount.
8.1 The Courier’s liability is limited to verified direct damages and within predefined limits.
8.2 Compensation applies only to shipment loss, damage, or delay as defined by the service.
8.3 No responsibility is assumed for indirect loss, revenue loss, or customs delays.
8.4 Additional insurance can be arranged for higher-value coverage.
9.1 Claims must be submitted within 6 months from the date of shipment.
9.2 The Courier will respond within 30 days for domestic and 90 days for international cases.
9.3 Compensation is paid according to the conditions in Section VIII.
10.1 Courier.nl processes personal data in accordance with GDPR.
10.2 The User confirms they are legally authorized to share recipient data.
10.3 Data is used solely for service provision and not shared beyond legal requirements.
11.1 Courier.nl may amend these Terms at any time.
11.2 Changes take effect 7 days after publication at https://courier.nl.
11.3 Continued use of the service implies acceptance of the updated Terms.
